The following are Wollombi-related excerpts from the agenda for the extraordinary meeting of Cessnock Council to be held at 6:30pm on Wednesday 16 June 2010 (177kb PDF).

WOLLOMBI

1.18 That the draft LEP retain the WB2 spot rezoning precinct at Wollombi as exhibited.

1.19 The draft LEP and associated maps be amended to replace those areas exhibited as E3 - Environmental Management zone with an RU2 - Rural Landscape zone in and around the Wollombi area.

1.20 An 'Environmentally Significant Land Map' added to the suite of maps supporting the draft LEP to protect, maintain and improve the diversity of landscapes.

1.21 The draft LEP be amended and new Clauses 6.7 Environmentally significant land, be added as a Local Provision to give effect to the proposed environmentally significant land mapping.

There were 45 written (17, 46, 52, 54, 57, 58, 89, 111, 117, 125, 182, 202, 213, 219, 222, 224, 225, 228, 237, 239, 240, 244, 261, 266, 273, 541, 585, 602, 613, 621, 624, 638, 640, 641, 644, 645, 646, 648, 654, 655, 664, 676, 868, 901, 924) and 179 proforma letters of objections and 23 letters (31, 552, 665, 870, 878, 881, 886, 891, 898, 899, 902, 904, 905, 908, 911, 912, 913, 916, 918, 919, 920, 921 and 922) of support for the proposed E3 Environmental Management zone for the Wollombi Valley.

Comment:

In response to the various submissions received on the proposed use and clarification by the DoP on the application of the E3 - Environmental Management Zone, a review has been undertaken of the land use capabilities and zone boundaries proposed in the Wollombi areas.

It is proposed to zone this area RU2 - Rural Landscape with an Environmentally Significant Lands Map added to the suite of maps supporting the draft LEP to protect, maintain or improve the diversity of landscapes.

It is recommended that the make up of the underlying land use zone and sensitive lands overlay mapping and the accompanying Local Provision, being Clause 6.7 Environmentally significant land, be re-exhibited for public comment prior to Council making a final determination on this matter.

Recommendation

  • The draft LEP and associated maps be amended to replace those areas exhibited as E3 - Environmental Management zone with an RU2 - Rural Landscape zone in and around the Wollombi area.
  • That an 'Environmentally Significant Land Map' added to the suite of maps supporting the draft LEP to protect, maintain and improve the diversity of landscapes.
  • The draft LEP be amended and new Clauses 6.7 Environmentally significant land, be added as a Local Provision to give effect to the environmentally significant land mapping.

(WB 2) Precinct

Four submissions (252, 611, 649 and 867) support the proposed WB2 spot rezoning at Canning Lane and Narone Creek Road, Wollombi due to the individual size and sitting of these lots in relation to Wollombi Village.

One submission (861) raised concerns that studies undertaken to justify the proposal are biased without careful consideration given to stormwater treatment, erosion and effluent disposal.

Comment:

The land in the WB2 Precinct has been identified through strategic analysis as being suitable for the purposes of residential development within a rural landscape and being within close proximity to adjoining closer settlement.

The provision of utilities to any new dwellings will be determined on merit through the assessment of a DA. At this time, issues such as sediment control and effluent disposal will be addressed.

Recommendation

  • That the draft LEP retain the WB2 spot rezoning precinct at Wollombi as exhibited.
