On October 19 2009 the Land and Environment Court quashed the approval of the massive Huntlee development.
Chris parker, President of the Sweetwater Action Group expressed his concern at the time of the decision that the failure of the Minister for Planning to defend the case meant the the residents group were denied the opportunity to have the Court hear all their arguments against the development.
Referring to comments in the Sydney Morning Herald on Monday 26th July, Mr Parker said "How can the developer make the claim that the merits of the proposal were never in question when the court was denied the opportunity of hearing our concerns?'
Mr. Parker said that since the decision in October last year another Environmentally Endangered community has been recognized by the Federal Government. This Community comprises a large part of the new application.
Further the approval of the F3 does not address the serious problem of the development being totally reliant on vehicular transport. Current applications by the Australian Rail and Track Corporation do not include any addition to passenger services, yet will see an increase in coal freight and associated vibration through the proposed residential development with the associated increase in diesel and dust emissions.
